Agreement
These terms govern your use of boulderinsight.com and its subdomains (the "site"), which are operated by Boulder Insight ("we", "us"). By using the site you agree to these terms. If you do not agree, please do not use the site.
These terms cover the website only. Consulting, training, and product engagements are governed by the written agreement for that work. Where a written agreement and these terms conflict, the written agreement wins.
What the site is for
The site describes our services, products, and training, publishes articles, and lets you contact us or join our newsletter. The content is general information about what we do and how we think about our field. It is not professional, legal, financial, or technical advice for your situation, and you should not rely on it as such without talking to us or another qualified adviser.
We work to keep the site accurate and current, but we do not promise that everything on it is complete, correct, or up to date at every moment.
Our content
Unless stated otherwise, everything on the site, including text, images, graphics, code samples, downloadable documents, and the site's design, belongs to Boulder Insight or is used with permission, and is protected by copyright and other intellectual property laws.
You may view, download, and print pages for your own reference and for evaluating whether to work with us. You may quote short excerpts with attribution and a link back to the page. You may not republish, sell, or redistribute substantial portions of the site, or remove any copyright or attribution notices, without our written permission.
Code samples in our articles are provided for you to learn from and adapt in your own work. They come with no warranty.
AI and search indexing. We publish machine-readable copies of our pages at /llms.txt and as markdown at each page address, and we welcome search engines and AI systems reading them to describe our business accurately. Bulk copying the site to train a model on our content, or reproducing it as your own, is not permitted.
Trademarks
Boulder Insight, the Boulder Insight mark, and the names VIZbot, Server Guard, BIG Cookie, Warpaint, TACO, and Tableau Risk Review are trademarks of Boulder Insight. Tableau is a trademark of Salesforce, Inc. Other product and company names on the site belong to their respective owners, and their appearance does not imply endorsement of us by them or of them by us.
Acceptable use
You agree not to:
- use the site in a way that breaks the law or infringes someone else's rights;
- submit false, misleading, or malicious information through our forms, or submit someone else's personal information without their permission;
- attempt to gain access to the admin area, other people's information, or any part of the site not intended for public use;
- interfere with the site's operation, for example by overloading our forms, probing for vulnerabilities, or introducing malicious code;
- use automated tools to scrape the site in a way that degrades it for other visitors.
We may block access from any source that we believe is misusing the site.
Forms and submissions
When you use the contact form or the newsletter signup you agree that the information you provide is accurate and yours to give. How we handle it is described in our Privacy Policy.
If you send us an idea, suggestion, or feedback through the site, you agree that we may use it without obligation to you. Do not send us anything confidential through the website. If you have confidential material to share, contact us first and we will agree an appropriate channel.
Demo portal and product sites
Our demo portal shows working examples of dashboards and applications. The data in those demos is synthetic or illustrative and does not describe any real organization, person, or event unless a demo says so explicitly. Demos exist to show what is possible and may change or be withdrawn at any time.
Some of our products are described or sold on their own sites, which may have their own terms.
Links to other sites
The site links to third-party websites and resources. We do not control them and are not responsible for their content, availability, or practices. A link is not an endorsement.
Disclaimer of warranties
The site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that information on it is accurate or complete.
Limitation of liability
To the fullest extent permitted by law, Boulder Insight and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the site, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the site will not exceed one hundred US dollars.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
Indemnity
You agree to indemnify and hold harmless Boulder Insight from any claim, loss, or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of the site.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Any dispute relating to the site will be brought in the state or federal courts located in Boulder County, Colorado, and you consent to their jurisdiction. If we are able to resolve a concern informally we would much rather do that, so please contact us first.
Changes
We may update these terms from time to time. The date at the top of this page shows when they last changed. Your continued use of the site after a change means you accept the updated terms.
General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the site.
